English translation for information purposes. In case of any discrepancy, the Hungarian version is binding, as the seller is a Hungarian sole proprietor and the contract is concluded under Hungarian law.
1. General provisions
These General Terms and Conditions (hereinafter: GTC) set out the terms of use of the kristalygomba.hu webshop (hereinafter: Webshop) operated by Tibor Farkas, sole proprietor (hereinafter: Seller).
Purchases in the Webshop are possible by placing an order electronically, subject to the conditions set out in these GTC. By placing an order, the Buyer accepts the provisions of these GTC.
The products sold in the Webshop are cultures used for making fermented drinks and related items. The products may contain natural, live cultures and therefore require proper storage and handling.
The information on the website is for informational purposes only and does not constitute medical or health advice.
1.1 Definitions
Seller / Service provider:
Tibor Farkas, sole proprietor, who operates the kristalygomba.hu webshop and sells the products.
Consumer:
a natural person acting outside their trade, self-employment or business activity.
Buyer:
any natural or legal person who places an order in the Webshop.

3. Products and prices
Prices in the Webshop are listed in Hungarian forint (HUF). The Seller is a small taxpayer exempt from VAT (AAM), therefore prices do not include VAT.
The Seller reserves the right to change prices without prior notice. Price changes do not affect orders already placed.
Due to their natural character, products may show minor differences in appearance, size or activity.

- Crystal Mushroom (half portion - 100 g): 4 900 HUF
- Crystal Mushroom (one portion - 200 g): 9 500 HUF
- Kefir grains (half portion - 12 g): 4 900 HUF
- Kefir grains (one portion - 24 g): 9 500 HUF
- Starter kit (tools): 12 000 HUF (currently available only in Budapest)
- Ice pack (100 ml): 500 HUF
4. Order process
- The Buyer selects the shipping region.
- The Buyer selects the shipping country.
- If the Buyer selected a Member State of the European Union, they choose the specific country from the list.
- The Buyer selects the shipping area (Budapest or countryside — for Hungary only).
- The Buyer selects the desired product(s) and quantity, adding them to the cart.
- The Buyer selects the shipping method.
- The Buyer selects the payment method.
- The Buyer selects the invoicing method (invoice or receipt — for Budapest home delivery and personal pickup. For all other options, an invoice is always issued).
- The Buyer enters the shipping and billing details (name, address, phone number, e-mail).
- The Buyer may add an optional note to the order.
- The Buyer accepts the Terms and Conditions and the Privacy Policy.
- Before finalising the order, the Buyer has the option to correct any data entry errors.
- By clicking the "Place order" button, in case of immediate card payment, the Buyer is redirected to the secure Barion payment interface.
After successful payment, the Seller confirms the order by e-mail.
- For any other payment method, after clicking "Place order" the Buyer receives an on-site confirmation, and the Seller confirms the order by e-mail.
The contract is concluded upon confirmation of the order.
The confirmation e-mail contains the details of the order, the price and the shipping costs.
5. Information on the electronic contract
The contract concluded in the Webshop qualifies as a contract concluded by electronic means.
The contract:
- is concluded in electronic form, and order data is stored for the period specified in the Privacy Policy,
- is not subsequently accessible,
- does not qualify as a written contract,
- is concluded in Hungarian.
Placing an order creates an obligation to pay.
6. Payment terms
In the Webshop, payment is made through the secure online payment system provided by Barion Payment Zrt. Accepted payment methods:
- Bank card (Visa, Mastercard, Maestro, American Express)
- Apple Pay
- Google Pay
- Barion wallet balance
Online card payments are processed through the Barion system. Card details are not passed on to the merchant. Barion Payment Zrt. is an institution supervised by the National Bank of Hungary, license number: H-EN-I-1064/2013.
7. Shipping terms
Orders are shipped exclusively within Hungary. Available shipping methods:
- Personal pickup (Budapest): at a pre-arranged time
- Home delivery (in Budapest, same-day delivery may be available in certain cases): by phone arrangement
- Home delivery to the countryside: by MPL courier service, 1-3 working days
- Parcel locker (Budapest and countryside): 1-3 working days
- Postapont / Poste restante: 2-5 working days
Shipping costs are shown in the order summary. Parcels are dispatched within 1-2 working days after successful payment.
The Seller is not liable for delays outside its control caused by the courier service, but will provide all reasonable assistance to resolve the issue.
The Buyer must inspect the parcel upon receipt. In case of visible damage, drawing up a report is recommended.
8. Storage and use information
Crystal Mushroom and other fermentation cultures may contain live microorganisms.
For the products to work properly, the Buyer must follow the storage and usage instructions provided on the website and in the user guide included with the parcel.
The Seller is not liable for quality deterioration resulting from improper storage, excessive heat exposure, contamination or incorrect use.
9. Right of withdrawal
Under Government Decree 45/2014 (II. 26.), the consumer is generally entitled to a 14-day right of withdrawal without justification. However, the law also specifies cases in which the right of withdrawal cannot be exercised. These exceptions are set out in Section 10 of these GTC.
Conditions for exercising the right of withdrawal:
- The intention to withdraw must be indicated by an unambiguous declaration (by e-mail to info@kristalygomba.hu, or by filling out the Online Withdrawal Form available in the Webshop).
- The product must be returned to the Seller (1141 Budapest, Kalauz utca 7., Hungary), properly packaged according to its nature.
- The cost of return is borne by the Buyer.
- The Seller refunds the amount due to the consumer within the statutory deadline, at the latest when the returned product has been received or when the consumer has credibly proven its dispatch.
9.1 Online withdrawal form
The consumer may exercise the right of withdrawal not only by e-mail but also by filling out the Online Withdrawal Form available in the Webshop.
After the online form has been successfully submitted, the system automatically sends an electronic confirmation to the e-mail address provided, recording on a durable medium (by e-mail) the fact and time of receipt of the withdrawal declaration.

10. Exceptions to the right of withdrawal
Under Section 29 of Government Decree 45/2014 (II. 26.), the right of withdrawal cannot be exercised:
- in the case of a product that is perishable or whose quality is preserved only for a short time,
- in the case of a sealed product which, for health or hygiene reasons, cannot be returned after being opened following delivery.
In view of the sensitive nature of live fermentation cultures, the Seller is entitled to examine the condition of the returned product and to check whether, under Government Decree 45/2014 (II. 26.), the right of withdrawal without justification applies to that product.
The live fermentation cultures sold by the Seller (such as Japanese Crystal Mushroom and Tibetan kefir grains) contain live microorganisms. The Seller examines every withdrawal declaration individually based on the applicable law, taking into account the nature and condition of the product and the exceptions set out in Government Decree 45/2014 (II. 26.).
11. Warranty and complaint handling
The Seller warrants that the products conform to the description at the time of the order.
The products are of a food-like nature, so the warranty period is limited to the period indicated on the packaging or in the user guide accompanying the product.
The products may contain natural, live cultures and therefore require proper storage and handling.

The Seller examines and responds to the complaint within 30 days.
12. Limitation of liability
The Seller is not liable for damages resulting from the improper use of its products.
The fermented drink prepared from Crystal Mushroom is not a medicine and does not replace medical treatment.
Consumption of fermented drinks and cultures may cause individual sensitivity.
The information on the website is for informational purposes only and does not constitute medical, dietary or health advice.
In case of a health problem, always consult a doctor.
The Seller is not liable for delays or performance failures resulting from events beyond its control (force majeure).

14. Copyright
The entire content of the Webshop — including texts, images, logos and graphic elements — is the intellectual property of the Seller and is protected by copyright.
Copying, distributing or using the content is only allowed with the Seller's written permission.
15. Final provisions
In matters not regulated by these GTC, the provisions of the applicable Hungarian legislation shall apply, in particular:
- Act V of 2013 on the Civil Code,
- Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses,
- Act CVIII of 2001 on certain aspects of electronic commerce services.
If any provision of these GTC proves to be invalid or unenforceable, this does not affect the validity and effect of the other provisions.
The Seller reserves the right to unilaterally amend these GTC.
Amendments enter into force on the day they are published in the Webshop.
